Further Development of New Trademark Law in Myanmar

缅甸新商标法的进一步发展

Recently, the official of IP Department has been introduced WIPO IPAS (E filing system) ,which shall be implemented by Myanmar IP Office, firstly for Trademark re-registration purpose. the new system will come into effect in January 2020.

最近，知识产权部的官员为了商标重新注册引入了WIPO IPAS（电子申请系统），该系统将由缅甸知识产权局实施，新系统将于2020年1月生效。

They will first launch the new system in a soft opening trial period which will last 6 months. During this period no new mark will be eligible for registration.New IP system would be e-service system – WIPO software is to be used.

他们将在为期6个月的过渡期内首次启动新系统。在此期间，新商标不可以注册。新的IP系统是电子服务系统–使用WIPO软件。

All old marks that has previously been registered will need to be refilled under the new system on a first to file basis within ( 6 ) months soft opening trial period. The new system will allow multiple class to be filed under the same mark. Only registered companies/agencies will be the only ones eligible to file for the re-registration during this soft opening period.We can re-use the old POA we have in hand, which does not limit  its validity. Scan Registered Declaration must be attached.

所有已注册的商标都必须在六个月过渡期内，在新系统下第一次注册的基础上重新注册。新系统将允许在同一商标下提交多个类别。 在此期间，只有已注册的公司/机构才有资格在过渡期内申请重新注册。我们可以重复使用现有的旧的委托书,但必须随附扫描注册的声明。

During the said " soft opening" period, all existing registrant need to re-file the application for trademark registration under the new law, which will provide protection for a period of ten ( 10 ) years.It is recommended to re-file the application at the earliest possible, in order to maintain the priority registration and protection of IP rights in Myanmar.

 在上述过渡期期间，所有现有注册人都需要根据新法律重新提交商标注册申请，新法将提供十年的保护。建议尽早重新提交申请，以保持缅甸知识产权的优先权和保护。

To re-register the rights to a trademark under the new online filing system, the requirements are:-

根据新的网上商标注册制度，重新注册商标的规定如下

-Clear specimen of the proposed mark.

-Owner's name and address

-Classes and lists of goods/services

-A scanned copy of Registered/ Renewed Declaration of Ownership of Trademark under old system.

-Old POA which does not limit its validity ( notarized and legalized )

-to collect use evidence on the market in Myanmar.

-申请商标的清晰样本

-所有者的姓名和地址

-商品/服务的类别和清单

-旧系统下的“已注册/续展商标所有权声明”的扫描副本。

-不限制其有效性的旧委托书（经过公证和合法化）

-收集缅甸市场上的使用证据。

As for fee associated with new process,  they have not been announced as yet.

 至于与新流程相关的费用，尚未公布。
